the change in salary ($76K to 120K) is a cause for concern. It depends how long ago you filed your labor. If it has been greater than 5 years, IMO the salary change may be ok. Rather than the titles, the job duties have to reasonably match.

The law does not allow for this. One can only transfer employment-based pd to employment based priority date. One can't transfer family based PD to employment based PD and vice versa.

I have a question regarding Multiple I-140s.
I applied for I-140 (PD: 2006) and it got approved in 11/2006;
I applied for LC-sub (PD:2004) and it is pending with USCIS
I applied for 485 in July 2007, My question is which PD will USCIS consider? Does it take the one with approve I140 or the pending one ? form 485 does not show the PD anywhere.

Moonlight, I am in a similar situation as you except that the person involved here is my spouse and the country of birth is srilanka and it is india in all her documents...i have done some research and found some interesting points for my scenario.May be we both can share info and help each other. you can mail me at nath4u@gmail.com. I probabably know the answer of this question but would still like to confirm, just to be sure:
- First I-797B Valid from Jan 2004 to Sep 2006 <- Note: wasn't for 3 years
- First Visa valid from Jul 2004 to Sep 2006
- 1st US Entry Date from Aug 2005 till present date
(been to india in Dec 2007 for 1 month for visa stamping)
- First i-94 valid from Aug 2005 to Sep 2006
-Extended I-797A from Sep 2006 to Jan 2009 <-Note: not extended for 3 yrs
-2nd Visa/I-94 valid from Dec 2007 to Jan 2009
My questions?
1. Can my H1B Visa be extended again? This will be my 2nd extension.
2. Till what Date can be extended?
a. Jan 2010 (6 yrs from 1st I-797)
b. Jul 2010 ( 6 yrs from 1st visa stamping)
c. Aug 2011 (6 yrs from 1st US entry)

Meaning 6 yrs from 1st US entry subtracting the time you are out of USA for vacaion.

Are you a 245i beneficiary: Yes/No
Let us see whether any regular EB3 guys are getting approved as per latest visa bulletins.
There is no salt rubbing to anyone.. we all r in the same sinking boat.. To know, if some one got approved in EB 3 might give us some hope.. let's keep bumping it up even if there are none or few approvals..
If some one feels salt being rubbed on his...a...go keep washing and putting ice on it till you you feel comfortable..
