My H1B visa may be getting expired Sep4th....but her old H4 approval is valid until 2011.
Is she safe even my visa (H1B) expired on 4th Sept.
If I apply F1 (Student Visa) now...it will take another 45 days to get F1 approval from INS.
So....what happens to her status? Is she valid to stay until she gets F1 approval notice?

You have to file her F-1 before your H-1 expires or gets denied, also you might need to show that she will continue to be on H-4 as of the date that classes start (based on you being on valid H-1 status). If this is not possible i suggest you file a change of status to B-2 and then you can decide what needs to be done, this will give you some breathing room.

If your extension paper come with I-94 attached, take it and staple it on your passport. (That is your new I-94). White paper need to keep in safe place. If it is expired, no value for it.

I have a last minute doubt - my H1B stamp on the passport is expired, so is the white I94 card. I have a valid I797 extension.
Can I use automatic revalidation? I am in doubt because the white I94 card is expired and I will have to present it to the officer at the port of entry.

Basically the receipt notice we will get soon would have a 'received date' and a 'notice date'.
I read in another forum that 90-day count starts from the received date.
I am not sure though!
Why is it that important? Before EAD was taking about 1.5-2 months. Now it will take a lot more, more than 90 days. I don't think now they will care about that 90 days thing. It wasn't a law requiring them to issue EAD in that period, they were just saying "if you haven't received in 90 days - call us" - that's all.

yes, he lucked out when his file/case/name/application got picked last Aug/Sept when that PD was current for a brief while.
I could be wrong, but don't the dependents also need their PDs to be current in order for their 485 to be approved?
The wife wasn't as lucky and her application wasn't picked while the window lasted, which is why she is still waiting. No?

Thanks guys for all the wisdom....I believe I knew the answer, but needed a 2nd opinion...
I had to renew my H1 visa, so was wondering what would happen if my GC was to get approved and my dependents remain pending, before the h1 is applied. My GC is still pending, hope to see some Green soon....maybe this year. All the best for all of you.

I checked my online status online. It only shows the application is recieved but not the name. If I create my profile would I be able to see my name when I check status online. I haven't created my profile yet.
